Welcome to African Fresh Market ("AFM", "we", "our", or "us"). By accessing or using our website, services, applications, or purchasing products through African Fresh Market, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our services.

2. About African Fresh Market

African Fresh Market is owned and operated by Tatem Inshunti Group LTD, a company registered in Rwanda. Tatem Inshunti Group LTD is a Private Company Limited by Shares, registered in Rwanda. Registered Office: KG 182 St19, P.O. Box 3030 Kigali, Imanzi, Bibare, Kimironko, Gasabo, Umujyi wa Kigali. African Fresh Market is a food and agricultural commerce platform operated by Tatem Inshunti Group LTD that sources products from farmers, cooperatives, producers, and approved supply chain partners and makes those products available to customers through the AFM platform. AFM is committed to improving food transparency, traceability, quality assurance, and access to trusted agricultural products across Africa.

3. User Accounts

To access certain features, users may be required to create an account. You agree to:

• Provide accurate information
• Keep your account information up to date
• Protect your login credentials
• Accept responsibility for activities conducted through your account

AFM reserves the right to suspend or terminate accounts that violate these Terms.

4. Products and Availability

We work directly with farmers, producers, and supply chain partners to source products offered through African Fresh Market. Product availability may vary due to:

• Seasonal production
• Harvest conditions
• Supply chain disruptions
• Inventory availability

AFM reserves the right to modify product offerings, pricing, quantities, and availability at any time.

5. Pricing

All prices displayed on the platform are subject to change without prior notice. While we strive to maintain accurate pricing, errors may occasionally occur. In such cases, AFM reserves the right to correct pricing errors and cancel affected orders where necessary. Applicable taxes, delivery fees, and service charges may be added during checkout.

6. Orders

When you place an order, you agree to provide accurate information required for processing and delivery. AFM reserves the right to:

• Accept or decline orders
• Limit quantities
• Cancel orders suspected of fraud or misuse
• Request additional verification when necessary

Order confirmation does not guarantee product availability until the order has been processed.

7. Payments

Payments are processed through approved payment service providers. By placing an order, you authorize AFM and its payment partners to process the applicable charges. Orders may remain pending until payment has been successfully confirmed. AFM reserves the right to cancel unpaid orders.

8. Delivery and Fulfillment

AFM will make reasonable efforts to fulfill and deliver orders within the estimated delivery timeframe. Delivery times may be affected by:

• Traffic conditions
• Weather conditions
• Inventory availability
• Operational factors outside our control

Delivery estimates are not guaranteed. Customers are responsible for providing accurate delivery information.

9. Product Quality and Food Safety

AFM works to maintain high standards of quality, freshness, and food safety. However, customers should inspect products upon delivery and promptly report any concerns. AFM may investigate quality-related complaints and determine appropriate remedies on a case-by-case basis.

10. Membership Programs

AFM may offer membership programs that provide benefits such as discounts, promotions, and exclusive services. Membership benefits are subject to the applicable membership plan and may be updated from time to time. Membership misuse may result in suspension or termination of benefits.

11. Prohibited Activities

Users may not:

• Engage in fraudulent activity
• Attempt unauthorized access to the platform
• Interfere with platform operations
• Use the platform for unlawful purposes
• Submit false information
• Abuse promotions, discounts, or membership programs

AFM may suspend or terminate accounts involved in prohibited activities.

12. Intellectual Property

All content, branding, trademarks, logos, designs, software, and materials associated with African Fresh Market remain the property of AFM unless otherwise stated. No content may be copied, reproduced, distributed, or used without prior written permission.

13. Limitation of Liability

To the maximum extent permitted by law, African Fresh Market shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the platform, products, or services. Our total liability shall not exceed the amount paid by the customer for the relevant order.

14. Modifications

AFM may update these Terms of Service from time to time. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by applicable laws and regulations in the jurisdictions in which African Fresh Market operates.
